These Terms & Conditions govern the relationship between ODONATA COSMETICS LTD and the users of the online store available at phytoskinlab.com (the "Website") when ordering and purchasing PhytoEssence natural cosmetics. Please read these terms carefully before using the Website and placing an order.

By using the Website and/or by placing an order you confirm that you have read these Terms & Conditions, accept them and undertake to comply with them.

2. Definitions

  • "Trader" / "We" means the company identified in Section 1 which operates the Website.
  • "Consumer" / "Customer" / "You" means any natural person who uses the Website and/or places an order for purposes outside their trade or profession.
  • "Goods" means a cosmetic product offered for sale through the Website.
  • "Order" means a request submitted through the Website to purchase one or more Goods.
  • "Contract" means the distance sales contract concluded between the Trader and the Customer under these Terms & Conditions.

3. Registration and ordering

An order may be placed either by registering a user account or without registration (as a guest). When registering, the Customer must provide true, current and complete information and keep their account credentials confidential. The Customer is responsible for all actions carried out through their account.

An order is placed by adding the desired Goods to the cart and completing the checkout steps, where the Customer provides delivery details and selects a payment method. Before finalising, the Customer is able to review and correct the contents of the order.

4. Prices and payment

All prices on the Website are stated in euro (EUR) and include 20% VAT unless expressly stated otherwise. The price of the Goods is the one displayed at the time the order is placed. Delivery costs are calculated and shown separately at checkout, before the order is confirmed.

Payment is made at the Customer's choice by: (1) cash on delivery upon receipt of the parcel, or (2) online card payment (Visa, Mastercard), as well as via Apple Pay and Google Pay, processed securely through the payment provider myPOS. The Trader does not store payment card data.

5. Conclusion of the contract

The contract is deemed concluded at the moment the Customer receives an order confirmation at the email address they provided. By confirming, the Trader accepts the order and undertakes to deliver the ordered Goods. The Trader reserves the right to refuse or cancel an order in case of an obvious price or availability error, out-of-stock items or suspected abuse, by notifying the Customer and refunding any amount paid.

6. Delivery

Delivery is carried out within the territory of the Republic of Bulgaria via the couriers Econt and Speedy — to a courier office/automated parcel station or to an address specified by the Customer. Detailed conditions, timeframes and prices are described on the "Shipping & Delivery" page, which forms an integral part of these Terms & Conditions.

7. Right of withdrawal and complaints

As a consumer you have the right to withdraw from the Contract within 14 days under the Bulgarian Consumer Protection Act, as well as the right to file a complaint where the Goods are non-conforming. The conditions, exceptions (including for unsealed cosmetics for hygiene reasons) and the procedure for exercising these rights are described in detail on the "Returns & Complaints" page.

8. Intellectual property

All content on the Website — texts, images, logos, trademarks, graphics, design and software — is subject to the intellectual property rights of the Trader or its partners and is protected by law. Copying, reproducing, distributing or using the content for commercial purposes without the prior written consent of the rights holder is prohibited.

9. Liability

The Trader takes care to keep the information on the Website accurate and up to date but does not warrant the absence of technical errors or inaccuracies. The Goods are cosmetic products for external use; the Customer must read the composition and usage instructions and perform a tolerance test in case of sensitive skin. The Trader is not liable for damage arising from improper use of the Goods or from failure to follow the manufacturer's instructions.

10. Protection of personal data

The processing of Customers' personal data is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and applicable law. Detailed information about the purposes, legal bases, retention periods and data subject rights is available in the "Privacy Policy".

11. Out-of-court dispute resolution

In the event of a dispute, the Customer may contact the Trader at the details provided for an amicable settlement. The Customer also has the right to file a complaint with the Bulgarian Commission for Consumer Protection (CPC) and to use the European Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

12. Governing law and competent court

All matters not settled by these Terms & Conditions are governed by the applicable law of the Republic of Bulgaria, including the Consumer Protection Act, the Electronic Commerce Act and the Obligations and Contracts Act. Any disputes that cannot be resolved out of court shall be settled by the competent Bulgarian court.

13. Amendments to the Terms

The Trader reserves the right to amend these Terms & Conditions at any time. The current version is published on the Website with the date of the last update indicated. Orders already placed are governed by the Terms in force at the time the relevant Contract was concluded.
